US equities & ETFs · for residents of India

Owning US stock from India, start to finish.

You are allowed to. The Reserve Bank’s Liberalised Remittance Scheme lets a resident individual send up to $250,000 abroad each financial year, across all permitted purposes combined, from their own funds; investing in listed overseas securities is one of the permitted purposes.

The schedule is published in full before you trade. Your bank’s currency conversion is not included — the rate and margin are set by your remitting bank, not by us.

The trade is the easy part. These four are what a first-time buyer usually finds out afterwards, so they are here instead.

TCS: a timing cost, not a fee

Above ₹10 lakh of cumulative LRS remittance in a financial year, 20% is collected at source. It is credited against your tax when you file your return; until then the money is out of your hands.

How TCS is credited

Gains are taxed as foreign assets

Gains are taxed at your slab rate if you sell within 24 months, and at 12.5% (without indexation) after that, plus surcharge and cess. The ₹1.25 lakh exemption that applies to Indian listed equity does not apply here.

How the tax works

Dividends are withheld in the US

US dividends are withheld at 25% when a Form W-8BEN is on file, otherwise 30%. You can claim the US tax already paid as a Foreign Tax Credit under the DTAA, up to the Indian tax on that dividend; if your slab rate is below 25%, part of it cannot be recovered.

Holdings are disclosed every year

If you are resident and ordinarily resident in India, you disclose these holdings each year in Schedule FA of your income-tax return (calendar-year basis). That includes years you did not trade.
